TERMS & CONDITIONS FOR UPLOADING YOUR CONTENT
1. Acceptance
By uploading photographs, videos, comments, or other content ("Content") through this platform, you agree to these Terms & Conditions.
2. Ownership
You confirm that:
- You are the creator and owner of the Content, or you have obtained all necessary rights and permissions to submit it.
- Submission of the Content does not infringe any copyright, trademark, privacy, publicity, or other rights of any third party.
3. Consent of Individuals
You warrant that any person who is identifiable in the Content has given their consent to be photographed, recorded, and for their image or likeness to be shared and used in accordance with these Terms.
You agree not to upload Content featuring individuals who have not provided such consent, particularly minors, unless consent has been obtained from a parent or legal guardian.
4. Prohibited Content
You must not upload Content that:
- Is unlawful, misleading, fraudulent, or deceptive.
- Contains hate speech, discrimination, harassment, threats, or abusive material.
- Contains nudity, sexually explicit material, or graphic violence.
- Promotes illegal activities or dangerous behaviour.
- Violates any intellectual property rights.
- Contains malware, viruses, or harmful code.
5. Content Licence
By submitting Content, you grant Nomad Adventure Tours (Pty) Ltd a worldwide, perpetual, irrevocable, royalty-free, non-exclusive licence to:
- Use, reproduce, modify, edit, adapt, publish, display, distribute, and share the Content.
- Use the Content in marketing, advertising, promotional campaigns, websites, social media channels, printed materials, presentations, and other business-related communications.
- Create derivative works from the Content.
6. No Compensation
You acknowledge that submission of Content is voluntary and that you will not receive payment, royalties, compensation, or other benefits for the use of the Content.
7. Removal and Moderation
We reserve the right, at our sole discretion, to review, reject, remove, or refuse publication of any Content for any reason without notice.
8. Indemnity
You agree to indemnify and hold harmless Nomad Adventure Tours (PTY) Ltd its directors, employees, contractors, and affiliates from any claims, losses, damages, liabilities, or expenses arising from your submission of Content or breach of these Terms.
9. Privacy
Personal information submitted with Content will be processed in accordance with our Privacy Policy and applicable data protection laws.
10. Agreement
By selecting the acceptance checkbox and submitting Content, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
